The Skilled Worker Visa is a points-based UK work visa for skilled foreign workers which allows them to live and work in the UK for an approved sponsoring employer for up to 5 years initially. This British visa can also be renewed for up to 5 years at a time if the skilled immigrant still meets the eligibility requirements. The foreign worker’s spouse/partner and dependent children under 18 years of age can also immigrate to the UK if they qualify for and are issued the relevant British visa.

Eligibility for the Skilled Worker Visa is based on a points system in which 70 points are required. Points can be received for having a UK job offer from a licensed employer in the United Kingdom that is at or above the minimum skills level and salary; having English language skills at or above the B1 intermediate level; and the applicant’s education. Foreign workers and their family members who live in the UK as legal residents for 5 years and satisfy all of the eligibility criteria may have the option to apply for permanent settlement, known as Indefinite Leave to Remain (ILR). After living in the UK with ILR status for 12 months and meeting all of the other eligibility requirements, a foreign worker and his or her family may have the opportunity to apply for British citizenship.

The Certificate of Sponsorship may be issued to a skilled foreign worker by an employer in the United Kingdom who is a licensed sponsor as part of the procedure to apply for a Skilled Worker Visa to the UK. The licensed sponsor is responsible to make sure the foreign worker they want to hire meets the necessary eligibility criteria. A foreign worker who wants to apply for a Skilled Worker Visa and is issued a Certificate of Sponsorship will not actually receive a paper document since everything is digital, but rather he or she will be given the Certificate of Sponsorship reference number which they will provide when they apply for the Skilled Worker Visa.

The Global Talent Visa is designed for an individual who is a leader or potential leader in digital technology, arts and culture, academia or research. The Global Talent Visa can be issued for up to five years and can be renewed as often as desired for up to five years at a time.

In order to apply for a Global Talent Visa, an individual will need to receive an endorsement from an approved endorsing organization in the UK that is relevant for his or her occupation. In order to study in the UK with a Tier 4 Student Visa, an applicant will generally need to be at least 16 years of age (parental consent is required if under 18 years of age); receive a Confirmation of Acceptance for Studies (CAS) to enroll full-time in an educational course from a licensed student sponsor; be able to read, write, speak and understand English adequately; and have enough financial resources to pay for the educational course and living expenses.

The first major step to applying for a Tier 4 Student Visa is to apply and be accepted to attend full-time a qualifying post-secondary educational institution (such as a university) in the United Kingdom. 

After the Confirmation of Acceptance for Studies (CAS) has been received from the educational institution in the United Kingdom, an international student living outside of the UK may apply for a Tier 4 Student Visa no more than 6 months prior to starting the educational course. The Student Visa Application Fee and Healthcare Surcharge will also need to be paid. A UK visa decision is usually received about 3 weeks after a complete Tier 4 Student Visa Application has been filed with the Confirmation of Acceptance for Studies (CAS) and all the required documents and fee(s) included. 

If approved for a Tier 4 Student Visa, the international student can relocate to the UK up to one month before the educational course begins if the course will last over six months.

The Tier 4 Student Visa is usually issued for up to 5 years to an international student who is at least 18 years of age and studying full-time for a university degree (the length of time the Student Visa is valid depends on the length of the educational course). There is an option to extend a Tier 4 Student Visa if necessary.

When a full-time international student with a Tier 4 Student Visa graduates from an approved educational institution in the United Kingdom (such as a university that is a licensed student sponsor), he or she can receive a British Graduate Work Visa to live and work in the UK for 2 years (3 years if they graduated with a doctorate degree).

After living in the UK for 5 years as a legal resident (for example, 3 years with a Tier 4 Student Visa and 2 years with a Graduate Work Visa) and satisfying all of the eligibility criteria, an individual may have the opportunity to apply for permanent settlement in the United Kingdom, known as Indefinite Leave to Remain (ILR). In general, after living in the UK for 12 months with ILR status and satisfying all of the eligibility requirements, an immigrant may be able to apply for British citizenship.

In general, a Graduate Visa to the UK allows an international student living in the United Kingdom with a valid British Tier 4 Student Visa, who graduates with a Bachelors Degree, Master’s Degree or Doctorate Degree (such as a PhD) from an approved university in the UK, to be able to work in the United Kingdom after they complete their course of study in the UK.

Foreign students with a valid British Tier 4 Student Visa who complete a Bachelor’s Degree or Master’s Degree in the UK can receive a Graduate Visa that is valid for two years, but if they earn a Doctorate Degree (such as a PhD) in the United Kingdom, they can get a Graduate Visa that is valid for three years.

The international student can apply for the British Graduate Visa while his or her Tier 4 Student Visa is still valid and once their education provider in the UK (such as the university they are attending) has confirmed that they successfully completed their educational program. A decision is normally received in about 8 weeks after the Graduate Visa Application has been filed online correctly along with the Application Fee and required documents.

The UK Graduate Visa permits an individual to search for jobs in the UK; work in the United Kingdom in most occupations at any skill level; and become self-employed.

The Graduate Degree holder’s spouse/partner and dependent children can also continue living in the United Kingdom if they qualify.

The Graduate Visa to the UK cannot be extended, however, it may be possible to apply for a different British visa (such as the Skilled Worker Visa) if the criteria are satisfied.

It should be noted that after living in the United Kingdom as a legal resident for a total of five years and meeting all of the criteria, a foreign national may generally apply for Indefinite Leave to Remain in the UK (i.e., permanent settlement).

The Health and Care Worker Visa is a British visa for qualified physicians, nurses, other healthcare professionals or social care professionals which allows them to live and work in the UK for a licensed sponsor for up to 5 years. This UK visa can also be renewed or extended as often as desired if the foreign worker continues to satisfy the eligibility requirements. The spouse/partner and dependent children under 18 years of age may also live in the UK if they are approved for the relevant British visa. 

After living in the UK as legal residents for 5 years, there may be an option to apply for permanent settlement, known as Indefinite Leave to Remain (ILR). The Intra-Company Visa allows a foreign national who is working for a company outside of the United Kingdom to relocate to the UK to work at the company’s British branch office.

There are two types of Intra-Company Visas.

The Intra-Company Transfer Visa is for a foreign employee who is being transferred to work in the UK branch office of the company and who has been working for the employer over 12 months (unless the employee will earn a yearly salary of £73,900 (British Pounds) while working in the UK).

The Intra-Company Graduate Trainee Visa is a British visa for an employee who has been working for a company for a minimum of 3 months who will relocate to the UK branch office to participate in a graduate training program for a specialist or managerial position.

In order to apply for an Intra-Company Visa to the UK, the employee must have been working for an organization which the British Home Office has approved as a sponsor and receive a Certificate of Sponsorship from his or her employer. The applicant will need to have an occupation that qualifies for the Intra-Company Visa while he or she is working in the UK and earn a minimum yearly salary of £41,500 (British Pounds) for the Intra-Company Transfer Visa or a minimum annual salary of £23,000 for the Intra-Company Graduate Trainee Visa.

A visa decision will usually be made within 3 weeks after a complete Intra-Company Visa Application was filed with all of the required documents and fee(s). The applicant’s spouse/partner and dependent children under 18 years of age may be included in the Intra-Company Visa Application.

The Intra-Company Transfer Visa is normally issued for up to 5 years or the amount of time stated on the Certificate of Sponsorship plus 14 days. This UK visa can be renewed for a maximum of 9 years within a 10-year period if the employee will earn at least £73,900 (British Pounds) per year; or a maximum of 5 years within a 6-year period if the employee’s salary is under £73,900 (British Pounds) per year.

Intra-Company Graduate Trainee Visa is usually issued for 12 months or the length of time stated on the employee’s Certificate of Sponsorship plus 14 days. The Intra-Company Graduate Trainee Visa cannot be renewed; however, an employee who has been working for the sponsoring employer outside of the United Kingdom for a minimum of 3 months prior to the date of their UK visa application may re-apply for another Intra-Company Graduate Trainee Visa. The total years that a foreign worker can live in the UK with an Intra-Company Graduate Trainee Visa is 5 years within the previous 6 years.

A Start-up Visa to the UK is granted to foreign entrepreneurs who are at least 18 years of age and want to launch a start-up business in the United Kingdom that is innovative or different from what currently exists in the United Kingdom. The applicant will need to receive an endorsement from an authorized endorsing organization in the United Kingdom that is either a business organization which has been supporting entrepreneurs living in the UK or from an institution of higher education (such as a university) in the United Kingdom.

The business that the applicant wants to open in the UK must be something different (i.e., “innovative”) from what is in the current British market; it must have good growth potential; and the business or original business concept must be endorsed by an approved endorsing organization in the United Kingdom.

The applicant must also read, write, speak and understand English at the B2 level or above according to the Common European Framework of Reference for Languages (CEFR). Someone applying for a Start-up Visa to the UK must also have at least £1,270 (British Pounds) in his/her bank account for 28 days in a row prior to applying for the Start-up Visa as proof of funds to support oneself.

A UK visa decision is usually received about 3 weeks after a complete visa application has been filed with all of the required documents and fees.

A Start-up Visa to the UK is normally issued for 2 years and cannot be renewed. The foreign entrepreneur’s spouse/partner and dependent children under 18 years of age may be able to relocate to the UK if they are approved for the relevant British visa. An entrepreneur who has been living in the UK with a Start-up Visa may be able to apply for an Innovation Visa if they meet the eligibility requirements.

The business that the applicant wants to open in the UK must be something different (i.e., “innovative”) from what is in the current British market; it must have good growth potential; and the business or original business concept must be endorsed by an approved endorsing organization in the UK. Temporary legal residents of the United Kingdom (for example, skilled foreign workers, international students, and their family members) must pay the Immigration Healthcare Surcharge (generally done during the UK visa application process).
